Humminbird Terms of Service

Humminbird Music is owned and operated by Plethora Productions. By using Humminbird, you agree to these terms.

Your account

You are responsible for accurate account information, account security, and activity performed through your account. You must meet applicable age requirements.

Your content

You retain ownership of content you create. You grant Plethora Productions the limited rights needed to host, process, transmit, display, moderate, back up, and make your content available according to your settings. You must own or have permission to upload and use all audio, video, images, performances, samples, and other material.

Copyright and platform media

Do not upload infringing content or use Humminbird to download media in violation of another service’s terms. Reference links do not transfer ownership or grant a license. Plethora Productions may remove disputed content, request ownership documentation, restrict repeat infringers, and preserve relevant records.

Community safety

Do not publish harassment, hate, exploitation, unlawful material, scams, malware, or content that creates a credible safety risk. Users may report or block content and accounts. We may moderate, limit, or remove content and suspend accounts when reasonably necessary.

Subscriptions

Subscriptions are processed by Apple and renew automatically unless canceled through the App Store. Prices, trial terms, and renewal details are displayed by Apple before confirmation.

Artist Pass payments, refunds, and chargebacks

Artist Pass is intended to let music artists offer paid fan access through Humminbird’s website checkout. Artists may choose their own prices for eligible fan access. Humminbird may use connected payout providers, payment processors, fraud checks, reserves, and payout delays before releasing funds to artists.

Fans may cancel recurring Artist Pass subscriptions according to the checkout terms shown at purchase. Cancellation stops future billing but does not automatically refund past payments. Full refunds may immediately revoke the related Artist Pass access. Partial refunds may adjust access or payout status depending on the circumstances.

Chargebacks, payment disputes, suspected fraud, failed payments, or unauthorized transaction claims may suspend Artist Pass access, block artist payouts, restrict accounts, and preserve related transaction records. If a dispute is resolved in the customer’s favor, access may remain revoked. If a dispute is resolved in Humminbird’s favor, access may be restored when appropriate.

Marketplace services, bookings, and platform fees

Humminbird may offer marketplace services including Artist Pass, Humminbird Exchange, and Humminbird Live. These services may allow creators, artists, performers, fans, hosts, venues, or buyers to request access, license music, book live services, make offers, pay deposits or advances, and receive payouts through website checkout and connected payout providers.

Humminbird may charge a platform fee, service fee, processing-related fee, or marketplace commission on paid marketplace transactions. Fees, deposits, balances, payout timing, refund terms, cancellation windows, and dispute procedures should be shown before checkout when live payments are enabled.

For Humminbird Live bookings, hosts are responsible for accurate event details, legal venue access, safety, equipment disclosures, and timely payment. Performers are responsible for accurate availability, professional conduct, performance obligations, and required payout onboarding. Cancellations, no-shows, unsafe events, incomplete performances, chargebacks, refunds, or off-platform payment pressure may lead to payout holds, account restrictions, dispute review, or removal from marketplace features.

Website

The website may display public sounds, public artist pages, comments previews, links, and app redirects. Uploading, Studio creation, private collaboration, and publishing are available only in the app unless Plethora Productions later releases those web features.

Service availability

Humminbird is provided on an “as available” basis. Creative work should be backed up and exported regularly. To the extent permitted by law, Plethora Productions is not liable for indirect, incidental, special, or consequential losses.

Termination, account deletion, and changes

You may stop using Humminbird at any time. You can request account deletion in the app or at humminbirdmusic.com/delete-account. We may retain records needed for legal compliance, safety, copyright disputes, subscriptions, security, backups, and abuse prevention. We may restrict access for violations, safety, legal compliance, or material risk. Updated terms will be posted with a new effective date.
